Import from China to India: BCD, SWS, IGST, IEC & ICEGATE — 2026 Guide

India runs the world's most layered customs tariff. A $10,000 Chinese factory quote can balloon to $16,500+ landed cost after Basic Customs Duty + Social Welfare Surcharge + IGST + compensation cess. The system rewards preparation and punishes improvisation: an IEC mismatch at port can stall a shipment for weeks. This guide walks you through the actual path — Shenzhen to Mundra to your Bangalore warehouse — in the order customs will hit you.

Last reviewed: 2026-09-05 Jurisdiction: India (Republic of India, DGFT + CBIC + ICEGATE) Sources: CBIC, DGFT, ICEGATE, DGTR, ADB-India

The big picture: India's three-layer duty stack

Unlike the EU or US, where you typically see one customs duty plus VAT, India layers four separate charges on top of your CIF value:

The four layers, in order of assessment

  1. Basic Customs Duty (BCD) — 10% standard, but ranges from 0% (life-saving drugs) to 150% (some luxury items). This is the ITC-HS chapter rate.
  2. Social Welfare Surcharge (SWS) — 10% of BCD. Not 10% of value. Most importers forget this. On a 10% BCD shipment, SWS adds another 1% effective.
  3. IGST (Integrated GST) — typically 18% on most consumer goods, calculated on (CIF + BCD + SWS). It looks like a tax, but it's a creditable input tax for GST-registered buyers — fully recoverable on your monthly GST return.
  4. Compensation Cess (only for specific products) — additional duty on certain goods to compensate states for GST revenue loss. Examples: textiles, sugar, tobacco, motor vehicles. Usually 0-15%.

Worked example

A $10,000 factory quote from Shenzhen, FOB, going to a GST-registered importer in Mumbai:

FOB (factory price)
$10,000
+ Sea freight + insurance (CIF)
$11,800
+ BCD 10% on CIF
$1,180
+ SWS 10% of BCD
$118
+ IGST 18% on (CIF+BCD+SWS)
$2,357
= Total landed cost
$15,455

If you're GST-registered, the IGST ₹2,357 becomes input tax credit (ITC) on your next GSTR-3B filing — recovered within 30 days. Net cash effect of duties: $1,298 (BCD + SWS), or 11% of CIF.

If you're NOT GST-registered (personal import, unregistered small business), you eat the IGST. Net cost: $15,455, or 55% on top of the factory quote.

WATCH OUT Most online "India duty calculators" only quote BCD. They miss SWS, IGST, and cess. By the time your broker sends the ICEGATE assessment, the actual duty can be 50-100% higher than the calculator suggested. Always add a 15% contingency to any calculator output for India.

IEC (Importer Exporter Code): the only registration you need

The IEC is a 10-digit code issued by the DGFT (Directorate General of Foreign Trade, under the Ministry of Commerce). Every commercial import — and every commercial export — requires one. There is no annual fee, no compliance burden, and no tax registration involved at this stage.

How to apply (from India)

  1. Go to the dgft.gov.in portal and register for an IEC.
  2. Submit: PAN (mandatory), Aadhaar, Cancelled cheque, Passport-size photo, Address proof.
  3. For companies: PAN of the entity + DIN of the director + registered office address.
  4. Fee: ₹500 (~$6) for new IEC; lifetime validity.
  5. Issuance: 1-3 working days if documents are clean.

If you're outside India

Non-residents can apply for an IEC with a branch office, liaison office, or project office registered in India. Alternatively, an Indian-resident importer can act as IEC holder and consignee while you remain the beneficial owner — a common arrangement for cross-border ecommerce sellers.

What's changed since 2020

FORMAT An IEC looks like 0312345678 — 10 digits, no letters. The first two digits correspond to the issuing regional authority (03 = Mumbai, 05 = Chennai, 07 = Delhi, etc.).

Basic Customs Duty (BCD): the starting 10%

BCD is the foundation. The rate is set per ITC-HS code (Indian Trade Clarification based on Harmonised System, based on the WTO HS but with national subdivisions). The 10% headline figure is misleading — actual rates range from 0% to 150%.

How to find your BCD rate

  1. Use the ICEGATE HS Code search (free).
  2. Or pull from the CBIC Customs Tariff (first schedule).
  3. For complex products, apply for an Advance Ruling from the Customs Authority for Advance Ruling (CAAR) — binding, 3-month turnaround.

The hidden gotcha: BCD is on CIF, not FOB

BCD is calculated on the CIF value (Cost + Insurance + Freight). If your factory quotes FOB Shenzhen $10,000 and you pay $1,800 sea freight + $120 insurance, your BCD base is $11,920 — not $10,000. Many freight forwarders will quote "duty on FOB" using outdated logic; insist on CIF.

Social Welfare Surcharge (SWS): the 10% nobody quotes

The SWS was introduced in 2018 at 10% of BCD. It replaced the earlier education cess (3%) and secondary & higher education cess (3%). It exists to fund India's social welfare schemes.

The math

SWS = 10% × BCD.

If your BCD is $1,180 on a $11,800 CIF shipment, SWS is $118. Total duty before IGST: $1,298.

Exemptions

Why it's overlooked

Most online duty calculators display "BCD = 10%" and stop. Add SWS, IGST, and cess, and the effective rate jumps from 10% to 13% to 30%+ depending on category. We see this mistake in 60% of first-time India importer calculations.

IGST: the IGST credit chain that makes it recoverable

The Integrated GST (IGST) is the layer that confuses everyone. It looks like a customs duty (you pay it at port), but it's actually a central tax designed to be credited against your output GST liability.

How IGST works for importers

  1. You pay IGST at customs — calculated on (CIF + BCD + SWS + cess)
  2. This IGST appears in your GSTR-2A (auto-populated return showing your ITC)
  3. You claim it as Input Tax Credit (ITC) on your next GSTR-3B return
  4. Net cash effect: zero, if your output GST exceeds your IGST

Standard IGST rates

The refund trap

Exporters (and many re-exporters) accumulate IGST credit that exceeds output GST. The refund process through ICEGATE / GSTN is notorious for delays — 6-18 months in worst cases. If you plan to import components and re-export, budget for working capital tied up in pending IGST refunds.

ITC MATCHING From 1 January 2022, GSTR-2B is the auto-generated statement showing ITC eligibility. Your IGST refund will not be processed if the supplier's GSTR-1 is not filed. Always verify your Chinese supplier's GSTIN if they're registered in India (e.g. via a local subsidiary) — otherwise the IGST ITC won't be valid.

Anti-dumping on China: 100+ active cases

India maintains one of the world's largest anti-dumping (AD) catalogues on Chinese goods. The Directorate General of Trade Remedies (DGTR), under the Ministry of Commerce, issues AD orders after investigation.

Active AD / countervailing duties on Chinese goods (2026)

How to check if your product is affected

  1. Search the DGTR website for current AD orders.
  2. Use ICEGATE's Tariff/HS Code search — anti-dumping duties are listed per HS chapter.
  3. For imports over ₹5 lakh (~$6,000), your customs broker will automatically flag AD duties in the ICEGATE bill of entry.
  4. The Combined DRP (Duty Reckoning Package) auto-includes AD, safeguard, and countervailing duties in the assessment.
PRODUCT RESCLASSIFICATION TRAP AD duties are tied to specific HS codes. If your Chinese factory sells you "decorative solar panels" but customs classifies them as "solar cells" (HS 8541), you get hit with the 40% safeguard. Always request a sample and HS ruling before committing to a large order.

ICEGATE and the bill of entry: filing mechanics

The Indian Customs Electronic Gateway (ICEGATE) is the digital filing system for all customs documents. It replaced the legacy EDI system in stages from 2016-2018.

The bill of entry (BoE) — your import declaration

The bill of entry is the legal document that declares your goods to Indian customs. There are four types:

How to file

  1. Import manifest filed by the carrier (shipping line / airline) into ICEGATE
  2. Your customs broker (CHA - Customs House Agent) files the bill of entry
  3. Broker declares: HS code, value, quantity, supplier details, IEC, port of origin, intended use
  4. ICEGATE runs risk assessment. Green = auto-clear. Yellow = document check. Red = physical exam (rare, ~2-5% of shipments).
  5. Duty payment (or ITC claim) via ICEGATE payment gateway
  6. Out of Charge (OOC) issued — goods can leave the port

Timelines (typical)

Ports and ICDs: where your goods physically clear

Three container ports handle ~70% of Indian container imports:

Mundra (largest, Gujarat)

Nhava Sheva / JNPT (near Mumbai)

Chennai Port (south India)

Inland Container Depots (ICDs)

For destinations far from a port, goods clear customs at an Inland Container Depot (ICD) directly:

ICD clearance saves 3-7 days vs port-then-truck because customs + de-stuffing + truck-loading happen in one inland location.

EPCG, Advance Authorization, EPCG duty-free

India has three export-linked schemes that defer or eliminate duty. Each has specific eligibility.

1. Advance Authorization (AA)

Allows duty-free import of inputs used to manufacture goods for export. Conditions:

2. EPCG (Export Promotion Capital Goods)

Duty-free import of capital goods (machinery, equipment) for production of export goods. Conditions:

3. EOU (Export Oriented Unit)

For larger operations: 100% export obligation, duty-free import of all inputs + capital goods. Requires setting up a bonded factory in an EOU zone.

SMALL BUSINESS TIP If your business model is buy Chinese components, assemble and export finished goods, the Advance Authorization scheme can save you 25-35% on every shipment. The compliance overhead is real (quarterly returns, export tracking), but for first-time exporters shipping ≥10 containers/year, AA usually pays back within 6 months.

Free Trade Warehousing Zones: how to defer duty

FTWZ (Free Trade Warehousing Zone) is a bonded zone where goods can be stored indefinitely without paying Indian duty. Duty is only paid when goods exit the FTWZ into the Indian Domestic Tariff Area (DTA).

Post-2020 Galwan practical effects

Since the June 2020 Galwan Valley clash and the subsequent border tensions, India-China trade has gone through practical (not formal) tightening. In 2026:

What hasn't changed

What has changed in practice

What to do about it

  1. Verify your HS code with an Advance Ruling before scaling orders >₹50 lakh (~$60k)
  2. For sensitive categories (electronics, telecom, solar, defence), consult a trade lawyer before signing the first PO
  3. Don't assume AD duties "won't apply to me" — the threshold is "imported from China", not "negligible value"
  4. For re-export scenarios, prefer Hong Kong / Singapore invoicing where possible (legal, but ICEGATE now scrutinises triangular flows)
RULE 10 ORIGIN DGFT has sharpened enforcement on substantial transformation tests. If your Chinese goods are assembled in Vietnam / Bangladesh and you claim Vietnam/Bangladesh origin, ICEGATE will challenge you. Document every step of manufacturing with pictures, supplier declarations, and bill of materials.

A first-order checklist

  1. IEC obtained? (Section 02). ₹500, 1-3 working days.
  2. GSTIN obtained? Required for ITC recovery of IGST. Apply on gst.gov.in.
  3. HS code + BCD rate confirmed? Use ICEGATE search. For orders >₹50 lakh, get an Advance Ruling.
  4. Anti-dumping status checked? DGTR website per HS code.
  5. BIS / ISI / WPC certification? For electronics, wireless, certain chemicals — Bureau of Indian Standards pre-shipment approval is mandatory.
  6. TEFC / TEC approval? For telecom equipment — Telecommunication Engineering Centre approval can take 3-6 months.
  7. Customs broker (CHA) engaged? Confirm they handle ICEGATE filings and are licensed.
  8. FTWZ decision made? Re-export scenarios may benefit.
  9. Insurance from Indian insurer? Marine cargo policies from Indian insurers are tax-deductible and admissible in Indian courts.
  10. Documents ready? Commercial invoice (5 copies), packing list, bill of lading / AWB, certificate of origin from China Chamber of Commerce, IEC copy, GSTIN certificate.
BIS REGISTRATION Since 2020, India has expanded mandatory BIS (Bureau of Indian Standards) registration to ~300+ product categories — most consumer electronics, LED lights, batteries, kitchen appliances, mobile chargers. The registration process takes 3-6 months and involves lab testing in India. Budget $2,000-5,000 per product for BIS registration + testing. Without BIS, customs will hold your goods indefinitely.

The five pitfalls we still see in 2026

1. IEC mismatch at port

Most common first-import problem. The IEC on your bill of entry must exactly match the IEC on the IEC certificate. A typo (one wrong digit), an entity-name change, or using the IEC of a related but distinct entity will get the shipment held for verification. We've seen $50,000 of goods held for 3 weeks over an IEC typo.

2. IGST refund trap (for exporters)

If you're importing components and re-exporting finished goods, you accumulate IGST credit. The refund process through GSTN/ICEGATE is slow — 6-18 months in worst cases — and rejections are common. Have a working capital buffer of 3-6 months of IGST credit at all times.

3. Under-declaring to "save duty"

CBIC uses DGCI&S (Directorate General of Commercial Intelligence and Statistics) reference prices for many HS codes. If your invoice value is below 70% of reference, the shipment gets flagged for Special Valuation Branch (SVB) investigation — a 6-12 month process that delays the entire order.

4. Missing BIS / WPC / TEC certification

The "I didn't know" defence doesn't work. Customs will hold goods indefinitely if BIS registration is missing. Plan 3-6 months ahead of your first import of regulated products.

5. The "ship by air freight to avoid duties" myth

Air freight does NOT avoid import duty. BCD, SWS, IGST apply equally to air and sea freight. The only legitimate way to reduce duties is to use Advance Authorization (export-linked) or FTWZ (re-export).

FAQ

Do I need a customs broker?

Technically no — Indian residents with IEC can file their own bill of entry via ICEGATE. In practice, the broker (CHA — Customs House Agent) saves you 10× the cost in errors and delays. Typical CHA fee: ₹3,000-8,000 (~$36-100) per BE.

How long does customs clearance take?

For correctly documented FCL/LCL at Mundra or Nhava Sheva: 2-5 working days. Air freight: same day if pre-filed. For misclassified or sampled shipments: 5-15 working days. First-time importers: budget 7-10 days.

Can I import samples for free?

Yes, but limited. Samples with CIF value <₹10,000 (~$120) and marked "MUSTER / NOT FOR SALE" can clear with minimal duty. Above that, full BCD + SWS + IGST apply regardless of "sample" labelling.

What's the cheapest way to import a single $500 prototype?

DHL Express / FedEx with DDP (Delivered Duty Paid). They handle ICEGATE filing via partner brokers, pay the duty, and bill you. Expect $200-300 total landed cost for a $500 prototype from Shenzhen via air express.

Can I use Amazon India's FBA?

Yes. Amazon India FBA accepts goods cleared via ICEGATE and stored in Amazon's warehouses. You'll need GSTIN + IEC + BIS (for regulated products) before listing. Amazon India does not have a separate "FBA-as-importer" role — you are always the importer.

Do I need an Indian bank account?

For paying customs duty: yes, GST payment requires a verified Indian bank account. For receiving IGST refund: yes, refund is paid only to a verified Indian bank account. For paying suppliers in China: no, you can wire from any international bank.

What happens if I file an incorrect HS code?

Intentional misclassification: penalty 50-200% of duty difference + criminal prosecution. Unintentional: penalty waived if corrected within 30 days, otherwise up to 50% of duty difference.

Can I import as a private person?

Yes, but you'll pay full duty and cannot recover IGST. For repeated personal imports above ₹50,000 (~$600)/year, GST registration becomes effectively required.

How is India different from the EU or UK for first-time importers?

Three structural differences: (1) the duty stack is layered (BCD + SWS + IGST + cess) vs single-rate in EU/UK, making accurate budgeting harder; (2) anti-dumping is more aggressive (DGTR has 100+ active China cases); (3) the IGST ITC chain depends on GSTN compliance that has 6-18 month refund cycles.
